Malham Inclosure
Enclosure or Inclosure is the term used to describe the consolidation or extension of land-holdings and generally it was applied to large areas which had been used communally, dividing it into fields farmed by individuals, or to waste such as marsh or moorland to be improved and brought into agricultural use. Large communal pastures were broken up and enclosed, and the strips of land which had been farmed under the open field system, were consolidated into small fields.
Many early enclosures of common lands and pastures were made by general agreement and from the 16th Century onwards, Private Enclosure Acts had to be passed by Parliament, but these became so frequent that in 1801 the first General Enclosure Act was passed to streamline the process. A further Act in 1845 appointed permanent Enclosure Commissioners who were authorised to issue Enclosure Awards without submitting them for Parliamentary approval. These Commissioners allocated plots which they considered to be a fair equivalent “in full and perfect satisfaction” of the pre-existing open lands and common rights. Their decisions were recorded in the Enclosure Award documents and were accompanied by a map prepared by an appointed surveyor. The Acts were used to enclose almost 7 million acres of land, 21% of England was enclosed by over 5000 Acts of Parliament. Around two thirds of this land had been arable and the rest was common or waste.
However as late as 1760, Malham village still had fields farmed in strips as they had been in the medieval period. This can be seen in the plan below, which shows the tenanted land held in West Malham by Thomas Lister in 1760, much of it still divided into strips. Henry Airton’s 24 acres was actually made up of 24 parcels of land, only seven were over an acre, the being largest 4a 1r 16p and most were less tha 3 roods, with the smallest being just 14 perches/poles ( just over a third of an acre).

Malham Inclosure Award 1850
To all to whom these presents shall come I Ralph Lodge of Bishopdale in the Parish of Aysgarth in the County of York Land Agent send greeting.
Whereas by a Provisional Order under the Seal of the Inclosure Commissioners for England and Wales, dated the Eleventh day of January One Thousand eight Hundred and forty seven by the necessary consents given to such order and by the Notice of the said Commissioners of their intention to proceed therewith the Inclosure of East and West Malham Pastures called Grisedale, Pikedhaw, Ewe Moor, Cove, Lings, New Close, Cross Field, Weets, Coden, Butterhaw and Slevina situate in the Township of Malham in the Parish of Kirkby Malhamdale in the West Riding of the County of York has been duly authorised under the Provisions of the Act passed in the Eighth and Ninth years of the Reign of Her present Majesty Chapter 118. The said East and West Malham Pastures being Land to the Inclosure of which under the said Act the previous consent of Parliament is not thereby required
And Whereas I the said Ralph Lodge have been appointed the Valuer in the matter of the said Inclosure and having made the Declaration required by the said Act have duly held all necessary meetings and drawn up and sent to the said Inclosure Commissioners my Report in writing in the matter of the said Inclosure with a Map in three parts numbered 1, 2 and 3 thereunto annexed and in all other respects complied with the provisions of the said Act
And Whereas all such objections as have been made to my said Report having been heard and all such inquiries having been made in relation thereto as the said Inclosure Commissioners have thought fit the said Inclosure Commissioners have authorised and directed me to cause to be drawn up and engrossed on Parchment my Award in the matter of such Inclosure.
Now Know Ye that in pursuance of the provisions of the said Acts and by virtue of the powers and authorities in me vested I the said Ralph Lodge the Valuer as aforesaid do make and declare this to be my Award in the matter of the said Inclosure and to this my Award I have annexed the Map referred to by my said Report
And I do hereby declare that I have set out and appointed and do hereby set out and appoint the following public Carriage roads or Highways that is to say
Public Roads in West Malham
One Public Carriage road or highway of the width of Twenty three feet to be called the “Malham and Langcliffe Road” commencing at a gate called Cove Gate marked L on the Map hereto annexed and extending in a North westwardly direction to a Gate called Outside Gate marked E on the said Map
One other public bridle and driving road of the width of nine feet to be called the “Settle Horse Road” commencing at and branching out of the said Public Carriage road or highway called the Malham and Langcliffe Road at the place marked G on the said Map and extending in a westwardly direction over a portion of Allotments numbered 23, 15, 5 and 1 to an ancient Gate called Stockdale Gate marked A on the said Map
One other public bridle and driving road of the width of nine feet to be called the “Kirkby Fell Road” commencing at and branching off from the said road called the Settle Horse Road at the place marked C on the said Map and extending in a southwardly direction over a portion of the allotment numbered 1 to an ancient Gate called “Sandy Gate” marked B on the said Map

And I direct and appoint that the said private Carriage and Occupation Road shall for ever hereafter be maintained and repaired by the Owners and proprietors for the time being of the allotments numbered 10 and 12 on the said Map in the following proportions videlicet Two hundred yards at the north end thereof by the owner and proprietor for the time being of the said allotment numbered 10 and the remainder at the South end thereof by the owner and proprietor for the time being of the said allotment numbered 12
One other private Carriage and Occupation road of the width of nine feet to be called “Henry and William Atkinson’s Road” commencing at and branching off from the said Malham and Langcliffe Road at the place marked G on the said Map and extending in a westwardly direction over a portion of the Allotment numbered 23 on the said Map to an ancient gate called “Flair Sleet Gate” marked FF on the said Map and extending over a portion of the allotment numbered 15 on the said Map to and into the allotment numbered 14 and terminating at the place marked GG on the said Map for the use of the owners and occupiers for the time being of the said allotments numbered 15 and 14
And I direct and appoint that the said last mentioned private carriage and occupation Road shall for ever hereafter be maintained and repaired by the Owners and proprietors for the time being of the allotments numbered 15 and 14 on the said Map in the following proportions viz: Six hundred yards at the east end thereof by the owner and proprietor of the said Allotment numbered 14 and the remainder at the west end thereof by the owner and proprietor of the said allotment numbered 15.
One other private Carriage and Occupation road of the width of fifteen feet to be called the “Sellgill Road” commencing at the place marked Z on the said Map and extending in a South westwardly direction over a portion of the allotments numbered 29 and 26 on the said Map to and into two certain ancient Inclosures called Sellgills marked CC and DD on the said Map for the use of the owners and occupiers for the time being of the said ancient Inclosures called Sellgills.
And I direct and appoint that the said last mentioned private Carriage and occupation road shall for ever hereafter be maintained and repaired by the Owners and proprietors for the time being of the said ancient Inclosures called Sellgills marked CC and DD on the said Map
One other private Carriage and Occupation road of the width of fifteen feet to be called the “Butterhaw Lane Road commencing at an ancient Gate called “Ewe Moor Gate” marked H on the said Map and extending in a Southwardly direction over a portion of the allotment numbered 29 on the said Map to an ancient Gate called Butterhaw Gate marked AA on the said Map for the use of the owners and occupiers for the time being of certain ancient Inclosures situate at the South End of the said Road
And I direct and appoint that the said last mentioned Private Carriage and Occupation road shall for ever hereafter be maintained and repaired by the Owner and Proprietor for the time being of the Allotment numbered 29 on the said Map.
One other private carriage and occupation road of the width of fifteen feet to be called the “Cove Road” commencing at and branching off from the said Malham and Langcliffe Road at the place marked K on the said Map and extending in a Northwardly direction over a portion of the allotments numbered 38 and 35 to and into the allotment numbered 34 and terminating at the place marked W on the said Map for the use of the owners and occupiers for the time being of the said allotments numbered 38, 35, and 34 and the owners and occupiers for the time being of certain ancient Inclosures situate on the East side of Malham Beck
And I direct and appoint that the said last mentioned Private Carriage and Occupation Road shall for ever hereafter be maintained and repaired by the Owners and proprietors for the time being of the allotments numbered 38 and 35 on the said Map and that each of such respective owners and proprietors for the time being shall make, maintain and repair so much of the said Road as passes into and over his said allotment
One other private Carriage and Occupation road of the width of fifteen feet to be called the “Shackletons Road” commencing at and branching off from the said Cove Road at the place marked Q on the said Map and branching and extending in an Eastwardly direction across the stream to and into an ancient Field called Freeda marked R on the said Map for the use of the owner and occupier for the time being of the said ancient Field called Freeda
And I direct and appoint that the said last mentioned private Carriage and Occupation road shall for ever hereafter be maintained and repaired by the owners and proprietors for the time being of the said Field called Freeda
One other private Carriage and Occupation road of the width of fifteen feet to be called “Lord Ribblesdale’s Road” commencing at and branching off from the said Cove Road at the place marked S on the said Map and then branching and extending in a North Eastwardly direction across the stream to and terminating at an ancient Gate leading to an ancient Inclosure called the Cove Close marked T on the said Map for the use of the Owner and occupier for the time being of the said ancient Inclosure called Cove Close.
And I direct and appoint that the said last mentioned private Carriage and Occupation road shall for ever hereafter be maintained and repaired by the Owner and Proprietor for the time being of the said field called Cove Close
One other private Carriage and Occupation road of the width of fifteen feet to be called “Betty Lunds Road” commencing at and branching off from the said Cove Road at the place marked U on the said Map and then branching and extending in a North Eastwardly direction across the Stream to and into certain ancient Inclosures called Cove Bottom and Cove Wood marked V on the said Map for the use of the Owners and occupiers for the time being of the said ancient Inclosures called Cove Bottom and Cove Wood.
And I direct and appoint that the said last mentioned private Carriage and Occupation road shall for ever hereafter be maintained and repaired by the owner and proprietor for the time being of the said field called Cove bottom.
One other private Carriage and Occupation Road of the width of fifteen feet to be called the “Mill Road” commencing at and branching off from the said Malham and Langcliffe Road at the Place marked M on the said Map and extending in a North westwardly direction over a portion of the Allotment numbered 38 to an ancient Mill marked N on the said Map for the use of the Owner and Occupier for the time being of the said ancient Mill
And I direct and appoint that the said last mentioned private Carriage and Occupation Road shall for ever hereafter be maintained and repairs by the owners and proprietors for the time being of the said Mill marked N
One other private Carriage and Occupation Road of the width of fifteen feet to be called “Henry Atkinsons Road” commencing at and branching off from the said Malham and Langcliffe Road at the place marked J on the said map and extending in a Southwestwardly direction over a portion of the Allotment numbered 40 on the said Map to an ancient Inclosure called “West Cote Land” marked O on the said Map for the use of the owner and occupier for the time being of the said ancient Inclosure called West Cote Land
And I direct and appoint that the said last mentioned Private Carriage and Occupation Road shall for ever hereafter be maintained and repaired by the Owner and Proprietor for the time being of the said field called West Cote Land only.
Springs in West Malham
And I do further declare that I have set out and appointed and do hereby set out and appoint the following Springs for the use of the owners of the allotments hereby set out in manner hereinafter mentioned that is to say
One Spring called “Crook Scar Spring” rising and situate in the allotment numbered 5 on the said Map to be conveyed thence by a drain or piping in and through a portion of the said allotment numbered 5 to and into the allotment numbered 10 and from thence to and into the allotment numbered 12 on the said Map for the use of the owners and occupiers for the time being of the said allotments respectively
And I direct and appoint that the owners and proprietors for the time being of the same allotments shall at all times hereafter repair and maintain the said Drain or piping so far as the same shall extend through their said allotments respectively
One other Spring called “Cam Scar Spring” rising and situate in the Allotment numbered 21 on the said Map to be conveyed by a Drain or Piping into and through a portion of the said Allotment numbered 21 to and into the Allotment numbered 20 and from thence to and into the Allotment numbered 4 situate in East Malham for the use of the Owners and Occupiers for the time being of the said Allotments respectively
And I direct and appoint that the owners and proprietors for the time being of the said allotment numbered 20 situate in West Malham and the allotment numbered 4 situate in East Malham shall at all times have free access to repair the said Drain or piping as laid down in the said portion of Allotments and shall for ever hereafter bear the expense of maintaining and repairing the said conveyance of the Cam Scar Spring in equal shares and proportions
One other Spring called “Cove head Spring” rising and situate in the allotment numbered 32 on the said Map to be conveyed by a Drain or piping into and through a portion of the said allotment numbered 32 to and into the Allotment numbered 22 and from thence to and into the allotments numbered 6 and 8 on the said Map situate in East Malham for the use of the Owners and Occupiers for the time being of the said Allotments respectively.
And I direct and appoint that the owners and proprietors for the time being of the said allotment numbered 22 situate in West Malham and the said Allotments numbered 6 and 8 situate in East Malham shall at all times hereafter have free access to repair the said Drain or Piping as laid down in the said portions of Allotments and shall for ever hereafter bear the expense of maintaining and repairing the said conveyance of the Cove Head Spring in equal shares and proportions
One other Spring called “Scarth Head Spring” rising and situate in the Allotment numbered 31 on the said Map to be conveyed by a Drain or piping into and through a portion of the said Allotment numbered 31 to and into the Allotment numbered 30 on the said Map for the use of the owners and Occupiers for the time being of the said allotments respectively
And I direct and appoint that the owners and proprietors for the time being shall at all times hereafter have free access to repair the said Drain or Piping as laid down in the said portions of Allotments.
And I further direct and appoint that the owners and proprietors for the time being of the said allotment numbered 30 shall for ever hereafter maintain and repair the said Conveyance of the “Scarth Head Spring”
One other Spring or Lake called “Malham Tarn” rising and situate in the Allotment numbered 1 in East Malham to be conveyed by a Drain, piping, or open cutting into and through a portion of the said Allotment numbered 1 to and into the Allotment numbered 4 and to and into a portion of a certain Pasture called Dean Moor also the allotments numbered 20, 21, 22, and 32 in West Malham and the allotments numbered 5,6 and 8 in East Malham for the use of the owners and occupiers for the time being of the said allotments respectively
And I direct and appoint that the owners and Proprietors for the time being of the same allotments shall at all times hereafter have free access to repair the said drain piping or open cutting as laid down in the said portions of Allotments
And I further direct and appoint that the owners and proprietors for the time being of the same allotments shall for ever hereafter bear the expence of maintaining and repairing the said Conveyance of the Malham Tarn Water in the following proportions that is to say

One other Public Carriage Road or Highway of the width of twenty three feet to be called the “Calton Road” commencing at and branching off from the said Grassington Road at the place marked M on the said Map and extending in a South Eastwardly direction over a portion of the allotment numbered 21 to the Boundary of Bordley Township as set out by the Ordnance Survey and marked N on the said Map
One other Public Carriage Road of the width of Twenty feet to be called the “Gordale Scar Road” commencing at the place marked H on the said Map and extending in a northwardly direction to and into the allotment numbered 16 and terminating at the place marked G on the said Map
One public footway of the width of three feet to be called the Malham or Trow Gate foot way commencing at and branching off from the said Lings Road at the place marked O on the said Map and extending in a Northwardly direction into and over a portion of the allotments numbered 8, 6, 5, 4 and 1 to an ancient Stile called “Lings Head Stile” marked P on the said Map.

And I declare that I have set out and appointed and do hereby set out and appoint in East Malham One private Carriage and Occupation Road of the width of fifteen feet to be called the “Park house road” commencing at and branching off from the said Grassington Road at the place marked K on the said Map and extending in an eastwardly direction over a portion of the Allotment numbered 21 to the boundary of Bordley Township as set out by the Ordnance Survey marked L on the said Map for the use of the owner and occupier of an ancient farm called Park House
And I direct and appoint that the said last mentioned private Carriage and Occupation Road shall for ever hereafter be maintained and repaired by the owner and Proprietor for the time being of the allotment numbered 21 on the said Map
And I further declare that I have set out unto the Churchwardens and Overseers of the Poor of the said Township of Malham All that piece or parcel of Land situate in West Malham called Malham Cove numbered 33 on the said Map containing four acres and eighteen perches to be held by them and their successors in trust as a place of Public resort for the Inhabitants of the Parish of Kirkby Malhamdale and the public at large
And I have also set out unto the said Churchwardens and Overseers of the Poor all that piece or parcel of Land situate in East Malham called Gordale numbered 16 on the said Map containing twelve acres and eighteen Perches to be held by them and their Successors in trust as a place of Public resort for the Inhabitants of the said Parish of Kirkby Malhamdale and the Public at large
And I further declare that I have set out all the remainder of the said pastures among the several persons hereinafter named being all the persons interested therein in the shares or allotments following set opposite to their respective names which allotments I have adjudged and determined to be proportionate to the value of the respective rights and interests of such several persons which have been claimed and allowed under the provisions of the said last mentioned Act that is to say I do set out, allot and award unto

And I order and direct that all the present and future owners and Occupiers of the same several Allotments shall have liberty at any time within the span of four Years from the confirmation of this my award by the said Inclosure Commissioners to get stones at the nearest and most convenient places for the purposes of fencing and inclosing their said several Allotments, and making and repairing the roads in over and upon the said Allotments
And I the said Ralph Lodge do hereby order direct and appoint that the several walls for inclosing the several allotments hereinbefore described not already set up and made, shall be raised, set up and made respectively within the space of two years from the confirmation by the said Inclosure Commissioners of my award by the several persons owners for the time being of the said several allotments on the sides hereinbefore in that behalf prescribed, on which sides respectively a T is marked or drawn thus fence on the said Map.

And I further order and direct that the several Allotments shall be fenced with a good and sufficient wall fence and that the stake shall be the centre of all the Fences.
