Presentments of the Jury

The jurors say upon their oath that Thomas Kidd of Calton aforesaid has overstocked the fields and pastures there with 20 sheep contrary to the penalty aforetime imposed by himself and other neighbours of Calton aforesaid : he therefore incurs the said penalty viz. iij s.iiij d. And that John Wilson has offended in a similar manner contrary to the penalty and is therefore in mercy iij s. iiij d. And that Christofer Nelson has offended as above contrary to the said penalty and therefore incurs the said penalty viz. iij s. iiij d. And that Richard Fysshe has overstocked the fields of Calton aforesaid with one ox in the season of fog (tempore foggei) namely in Long Swaythes ; he is therefore in mercy vij d. And that Thomas Kidde aforesaid has trespassed within the fields and pastures of Calton aforesaid with one mare eating and treading down the grass and herbage there growing ; he is therefore in mercy ij s. And that the same Thomas Kidd has had and kept three “timones vocat’ thre Tethers ” * contrary to the penalty of ij s for each tether ; he therefore incurs the said penalty viz. vi s. And that Richard Armysted has offended in like manner contrary to the said penalty with one horse and one calf and is therefore in mercy iiij s. And that John Husband has offended as above contrary to the said penalty with one ox and is therefore in mercy ij s. And that Henry Nelson has had one Tether (timonem) contrary to the said penalty and has therefore forfeited the said penalty viz. ij s. And that John Hall, junr, has offended as above contrary to the said penalty with one mare and is therefore in mercy ij. And that Alfred Swyer by Henry Fell his servant has cut six ash trees and is therefore in mercy ij s.

Penalty

A penalty was laid on Henry Nelson, John Hall, junr., and Richard Armysted by the jury of this court that each of them shall build up their walls (and cleanse their ditches) to the height (finem) of their coping ably and defensibly before the 1st day of May next under a penalty for any portion insufficiently built nimium fact’ of iij s. iiij d.
